TICKET SALES REGULATIONS FOR GENERAL PUBLIC

FIFA Ticketing AG

1. Purpose of these Ticket Sales Regulations

1.1 These Ticket Sales Regulations shall applyto, and govern, the sales of tickets by FIFA (“Tickets”) to individuals (i) not being a resident of Brazil and(ii) not purchasing a Ticket in a Venue Ticketing Centre in Brazil (as definedbelow) for match(es) (“Matches”) ofthe FIFA Confederations Cup Brazil 2013 (“Competition”)that may be made available by FIFA Ticketing AG, a subsidiary of FédérationInternationale de Football Association (collectively, “FIFA”).

 

1.2 The number of Tickets made available forsale to the general public will be determined by FIFA for each Match. Due totemporary media facilities and Ticket allocations reserved by FIFA for customergroups other than the general public, which may both vary for each Match aswell as further security or other organisational needs, this number of Ticketsis never equivalent to the total number of seats in the stadium in which aMatch takes place (“Stadium”).During the Competition on any given Match day, the Stadium is under the controlof FIFA, the local organizing committee for the 2014 FIFA World Cup™ (Copa doMundo da FIFA 2014 – Comitê Organizador Brasileiro Ltda.) (“LOC”), the FIFA Ticketing Center (“FTC”), the FIFA Ticketing Office (“FTO”), or the Stadium management and/orthe Brazilian public authority(ies) responsible for safety and security inconnection with the Matches, and their respective employees, volunteers,agents, representatives, officers and directors (all together “FIFA Confederations Cup Authorities”).

1.3 The sale of Tickets (i) by 2014 FIFA World Cup Venda de IngressosLtda to individuals beinga resident of Brazil or purchasing a Ticket in a Venue Ticketing Centrewithin Brazil (as defined below) or (ii) to customer groups other than thegeneral public or (iii) that are part of a ticketing product containing otherbenefits, products and/or services in addition to the Tickets, such as, but notlimited to, parking and/or catering services will be governed by specific salesregulations applicable for these forms of sale of Tickets.

 

 

 

2. Ticket Application Form

 

2.1 The online or hard-copy Ticket applicationform, as applicable, made available by FIFA, the FTC or any other third partyauthorised by FIFA, are the means through which an individual may request topurchase a specified number and category of Tickets for Matches in accordancewith its terms and conditions, including, without limitation, these TicketSales Regulations (“Ticket ApplicationForm”).

 

2.2 The individual completing and submitting theTicket Application Form (“TicketApplicant”) will be solely responsible for the submission ofthe Ticket Application Form in a timely, complete, undamaged and unchanged formpursuant to these Ticket Sales Regulations and the Ticket Application Form.Late, incomplete, changed or damaged Ticket Application Forms will be rejectedby FIFA. Additional notes, requests, attachments, appeals, changes or furtheralterations to the standard offer by the Ticket Applicant which may becontained in, or attached to, the completed Ticket Application Form will not beconsidered or accepted by FIFA.

 

3. Selection of Ticket Categories

3.1 Under these Ticketing Sales Regulations,FIFA sells Tickets for all Matches to the general public in four (4) differentprice categories, defined as Ticket category 1 to 4 (“Ticket Category”), with Ticket Category 1 representing the highestprice category and Ticket Category 4 the lowest price category. All Tickets in TicketCategory 4 (“Category 4 Tickets”) willbe sold exclusively to, and must be used by, individuals resident in Brazil.The Ticket Applicant may only provide Category 4 Tickets to other residents ofBrazil. The Ticket Applicant must indicate in the Ticket Application Form theTicket Category requested for each Match. FIFA determines the categorisation ofeach seat in the Stadium on a Match-by-Match basis. The Ticket Applicant mayonly apply for one (1) Ticket Category per Match unless permitted under section3.2 below.

3.2 If the Ticket Applicanthas duly indicated his consent in the Ticket Application Form to be allocatedTickets in a lower Ticket Category than that Ticket Category specified ashis/her first choice, the Ticket Application Form completed and submitted forhis/her first choice shall be deemed to implicitly contain the TicketApplicant’s offer to purchase Tickets in such lower Ticket Category (subject toavailability and the sales restrictions on Category 4 Tickets).


4. Sales Restrictions

 

4.1 THE TICKET APPLICANTCAN ONLY APPLY FOR A MAXIMUM OF SIX (6) SINGLE TICKETS FOR UP TO TEN (10)MATCHES PER HOUSEHOLD (I.E. A TOTAL OF 60 TICKETS) AND ONLY FOR ONE SINGLEMATCH ON ANY GIVEN MATCH DAY. THE TICKET APPLICANT CAN ONLY APPLY FOR CATEGORY4 TICKETS IF THE TICKET APPLICANT IS RESIDENT IN BRAZIL. 

 

4.2 ALL TICKET APPLICATIONFORMS RECEIVED FROM A TICKET APPPLICANT WILL BE AUTOMATICALLY REJECTED BY FIFAIF THE TICKET APPLICANT

 

 

(i)          APPLIES FOR MORE TICKETS OR CATEGORIES THANPERMITTED PER MATCH OR FOR MORE MATCHES THAN PERMITTED PURSUANT TO THESE SALESREGULATIONS;

 

(ii)       APPLIES FOR MORE THAN ONE SINGLE MATCH ON THESAME MATCH DAY;  

 

(iii)     APPLIES FOR A CATEGORY 4 TICKET BUT IS NOTRESIDENT IN BRAZIL; OR

 

(iv)      SUBMITS MULTIPLE TICKET APPLICATIONS FOR THESAME MATCH.

 

4.3 THE SALES RESTRICTIONSSET FORTH IN SECTIONS 4.1 and 4.2 ABOVE SHALL APPLY TO ALL PERSONS IRRESPECTIVEOF WHETHER A PERSON APPLIES HIMSELF/HERSELF AS TICKET APPLICANT OR IS NAMED ASGUEST IN OTHER TICKET APPLICATION FORMS. THEREFORE A TICKET APPLICATION SHALLBE AUTOMATICALLY REJECTED FOR THE PERSON IN VIOLATION OF ANY OF THESE SALESRESTRICTIONS AS TICKET APPLICANT AND/OR GUEST.

 

5. Availability of Tickets 

5.1 Tickets will be made available in differentsales phases as described in the Ticket Application Form and further Ticketsales materials which FIFA may publish from time to time. FIFA’s ability tosatisfy a request for Tickets as specified by the Ticket Applicant in theTicket Application Form depends on the total number of Tickets requested fromTicket Applicants and, with respect to certain sales phases, the results of therandom selection draws for oversubscribed Matches. Tickets are only availablewithin the available Ticket allocations. FIFA may release additional Ticketsfrom reserved allocations for sale to the general public from time totime. 

 

6. Ticket Purchase Offer

6.1 Completion and submission of the TicketApplication Form to FIFA, the FTC or any other third party authorised by FIFAconstitutes an irrevocable and binding offer to FIFA by the Ticket Applicant to purchase the Ticketsidentified in the Ticket Application Form. However, the Ticket Applicant´soffer for a certain quantity of Tickets for a Match shall be deemed toimplicitly contain the Ticket Applicant’s offer to purchase the same, or alower, number of Tickets for the same Match.

6.2 The Ticket Applicant must be of legal age tosubmit to FIFA a binding offer for the purchase of a Ticket.

6.3 THE TICKET APPLICATION FORM MAY BE CHANGED OR CANCELLED BY THETICKET APPLICANT AFTER SUBMISSION UNTIL SUCH DATES AS INDICATED IN THE TICKETAPPLICATION FORM.  

6.4 NEITHER COMPLETION NOR SUBMISSION OF THE TICKET APPLICATION FORM BYTHE TICKET APPLICANT, NOR FIFA’S ACKNOWLEDGEMENT OF RECEIPT OF THE TICKETAPPLICATION FORM GUARANTEES THE AVAILABILITY OF TICKETS FOR THE TICKETAPPLICANT, OR CONSTITUTES THE CONCLUSION OF THE SALE OF TICKETS. IN ORDER TO BESUCCESSFUL A TICKET APPLICATION MUST BE PROCESSED BY FIFA PURSUANT TO SECTION 7BELOW.

7. Acceptance by FIFA

7.1 If Tickets are available and FIFA partiallyor fully satisfies the request stipulated in the Ticket Application Form byallocating Tickets to the Ticket Applicant, the Ticket Applicant will beprovided with a confirmation of the transaction by e-mail, post, SMS, fax,personal delivery or otherwise (“TicketConfirmation”). The Ticket Confirmation will specify the quantity ofTickets allocated to the Ticket Applicant, the Ticket Category, the venue andthe Match (i.e. the number of the Match according to the Match schedulecomprised in the Ticket Application Form, but not necessarily the specificationof the participating teams). The Ticket Confirmation will not identify specificseat numbers, which will only be assigned in a later stage, pursuant to section10 below. The issuance or remittance of the Ticket Confirmation representsFIFA’s partial or full acceptance of the Ticket Applicant’s offer andconstitutes the conclusion of the agreement for the sale of Tickets (“Ticket Sales Agreement”). FIFA maynotify unsuccessful Ticket Applicants, without being required to provide anyreasons for the rejection of a Ticket application.


7.2 All Ticket sales are final. Anyone who purchases,holds or uses a Ticket (“Ticket Holder”)cannot elect to cancel a purchase or return Tickets after conclusion of thesale, provided however, that certain third party transfers by a successfulTicket Applicant may be permitted in limited circumstances pursuant to FIFA’sTicket transfer policy, which will be defined by FIFA and made available onwww.FIFA.com; FIFA may cancel the Ticket and terminatethe Ticket Sales Agreement, fully or partially, pursuant to the FIFAConfederations Cup Brazil 2013 General Terms and Conditions for the Use ofTickets (“GTCs”) and these TicketSales Regulations.

 

8. Price; Taxes; Fees; Currency 

8.1 The price for Tickets is determined by FIFA and will be set out in the Ticket Application Form. Ticketprices will depend on (i) the Ticket Category, and (ii) the stage of theCompetition (i.e. group stage, semi-finals, third place Match and final). Inaddition, the price of Tickets for the opening Match is higher than the priceof Tickets for the other group stage Matches. The prices determined by FIFA forthe Ticket Categories depending on the stage of the Competition shall remainthe same throughout all sales phases. All prices include all applicabletaxes. 

8.2 Due to the high levelof administration connected with TSTs, in addition to the price printed on theface of each Ticket, an additional TST fee will be due for all TSTs, as setforth in the Ticket Application Form.   

8.3 The price printed onthe face of each Ticket sold by 2014 FIFA World Cup Venda de Ingressos Ltda, inBrazil is fixed in Brazilian Reais and the price printed on the face of eachTicket sold by FIFA Ticketing AG is fixed in US Dollars, and such face pricesshall not be changed throughout the sales process, regardless of currencyexchange fluctuation.

8.4 In any and all Ticket transactions in othercurrencies, which need to be converted into US Dollars, currency exchanges willbe determined by the Ticket Applicant’s payment card company during the billingprocess. Further information on applicable currency exchange rates may beobtained from the Ticket Applicants’ payment card company.  In case of wire transfers, the currency exchangerate will be based upon the exchange rate offered by the bank where the TicketApplicant requests the wire transfer, as determined on the date that the wiretransfer is requested by the Ticket Applicant.

 

9. Payment Process

9.1 FIFA will accept such means of payment asindicated in the Ticket Application Form.

9.2 The nominated paymentcard to purchase Tickets must be registered in the name of the TicketApplicant. Any Ticket Application Form nominating a payment card not registeredin the name of the Ticket Applicant may be rejected by FIFA. The TicketApplicant must ensure that his nominated payment card is valid for the durationof the applicable Ticket sales phase, that all required information is providedand confirmed, and there is sufficient credit for the transactionrequested.  In case of a successfulTicket application, FIFA will charge the nominated payment card prior toissuance or remittance of the Ticket Confirmation and without any specificnotification being required. If FIFA is not able to charge the nominatedpayment card, the Ticket application will be automatically rejected.


9.4 FULLPAYMENT OF ALL TICKETS IS OF ESSENCE AND A MATERIAL OBLIGATION OF THE TICKETAPPLICANT. If FIFA only receives partial payment from the Ticket Applicant,or the payment is not received on time, the Ticket application may be rejectedby FIFA in its entirety. Any and all bank or other charges incurred as a resultof the payment with a payment card or currency conversion will be the soleresponsibility of the Ticket Applicant.

9.5 Due to the nature and operational structureof the sale of Tickets of the Competition simultaneously on a worldwide basisin separate sales phases, in particular the time constraints related thereto, TIMELY AND DUE PAYMENT TO FIFA IS OFESSENCE AND A MATERIAL OBLIGATION OF THE TICKET APPLICANT and

(i)      no payment by the Ticket Applicant will beaccepted by FIFA after the payment dates set forth in section 9.2 above or throughany other means of disclosure; and

(ii)    no additional period of time to cure the full orpartial non-payment will be granted to the Ticket Applicant by FIFA.

 

10. Seating

10.1 FIFA will assign a specific seat to eachTicket. FIFA will endeavour, but cannot guarantee, that all seats assigned toTickets for a Match which are allocated to a successful Ticket Applicant willbe located adjacent to one another. Seats assigned to a Ticket Applicant may belocated in different sections, rows or blocks of seats.  FIFA cannot provide adjacent seats to personssubmitting separate Ticket Application Forms.

10.2 THE TICKET APPLICANT ACKNOWLEDGES THAT THESPECIFIC LOCATION OF A SEAT WITHIN A TICKET CATEGORY DOES NOT CHANGE THE PRICEOF THE TICKET AND THAT A SEAT MAY BE LOCCATED ADJACENT TO THE BOUNDARIES OF ASTADIUM SECTOR OR A SEAT OF ANOTHER TICKET CATEGORY.

11. Collection of Tickets

11.1 Tickets allocated by FIFA to the Ticket Applicantwill be made available for collection by the Ticket Applicant at the ticketingcentres operated by FIFA in all venues of the Competition prior and during theCompetition (“Venue Ticketing Centres”)at such time and place as described in the Ticket Application Form. All Ticketscomprised in a successful Ticket application must be personally collected bythe Ticket Applicant. Proper identification with embedded photo and/or thepayment card used in the transaction must be presented at the Venue TicketingCentres as specified in the Ticket Application Form. The locations of the VenueTicketing Centres will be made available at www.FIFA.com, the Ticket Application Form and further Ticketsales materials which FIFA may choose to publish. Ticketsmay only be collected after receipt of full payment by FIFA.

 

11.2 THE PRESENTATION OF PROPER IDENTIFICATION AND/OR THE PAYMENT CARD USED INTHE TRANSACTION PURSUANT TO SECTION 11.1 REPRESENTS A MATERIAL OBLIGATION OFTHE TICKET APPLICANT.


12. Ticket Applicants with Disabilities 

12.1 FIFA will make available a limited numberof Tickets exclusively for individuals with disabilities as described in theTicket Application Form. Valid proof of disability will be required.

12.2 Any successful disabled Ticket Applicantwill be offered the opportunity to receive on a complimentary basis oneadditional Ticket for his/her accompanying person (“Companion”) as described in the Ticket Application Form.

12.3 Any Ticket Applicant who is unable toattend a Match without a wheelchair needs to address the requirement of awheelchair in the relevant section of its Ticket Application Form. Ticket Applicantswith disabilities not requiring a wheelchair should contact the FTC (at thecontact information set out in section 16 below) regarding their specificrequirements.


13. Personal Data

13.1 The Ticket Applicant will ensure that thepersonal data initially required to be provided by the Ticket Applicant as setforth in the Ticket Application Form for the application for, and payment andcollection of, the Tickets is up-to-date at all times until the day of theMatch for which a Ticket has been allocated. Ticket Applicants will be given the opportunity to update their personaldata.  If a Ticket application is unsuccessful or rejected, the Ticket Applicant may requestdeletion of the personal data provided by contacting the FTC (for contact detailsplease see section 16).

13.2 The Ticket Applicant acknowledges andagrees that the personal data provided to FIFA pursuant to these Ticket SalesRegulations will, subject to applicable laws, be used, processed, stored andtransferred to third parties designated by FIFA (located both within andoutside of Brazil) for purposes relating to (i) Ticket sales and allocationprocedures, (ii) any relevant safety and security measures, and (iii) rightsprotection measures in connection with the Competition. The Ticket Applicantacknowledges his responsibility to obtain the consent of each of his/her Guestidentified in the Ticket Application Form to use their personal data to thesame extent, and for the same purposes.

13.3 In addition, provided that consent has been specifically given by the Ticket Applicantin the Ticket Application Form, the Ticket Applicant acknowledges and agreesthat the personal data about the Ticket Applicant provided to FIFA pursuant to these Ticket SalesRegulations may also be used for purposes relating to otherproducts and services of FIFA or third parties determined by FIFA in connectionwith commercial activities that may be of interest to the Ticket Applicant.

14. Acceptance of Ticket Sales Regulations, GTCs and Stadium Code ofConduct

14.1 By completing and submitting the TicketApplication Form, the Ticket Applicant irrevocably agrees, acknowledges, andundertakes to fully comply with, these Ticket Sales Regulations, the GTCs andthe applicable safety and security measures adopted by any of the FIFAConfederations Cup Authorities, which shall be reflected in the stadium code ofconduct (“Stadium Code of Conduct”).The Stadium Code of Conduct will be made available at www.FIFA.com, registered with theRegistry Title and Deed (”Registro deTítulos e Documentos – RTD”) pursuant to section 17.5 below and will be posted at the Stadium.

14.2 Each Ticket Applicant shall be fully responsible for ensuring thateach Ticket Holder who, directly or indirectly, receives a Ticket allocated tothe Ticket Applicant has read, understood, accepted and is bound by the GTCsand the Stadium Code of Conduct. For that purpose, the Ticket Applicant willprovide such Ticket Holder with a copy of the GTCs and the Stadium Code ofConduct or will direct such Ticket Holder to where the GTCs and the StadiumCode of Conduct are made available.

15. Limitation of Liability

 

THE FIFA CONFEDERATIONS CUPAUTHORITIES SHALL NOT BE HELD LIABLE FOR ANY:

(I) INCORRECT OR INCOMPLETECOLLECTION, INPUTTING, TRANSFER OR HANDLING OF DATA AND FURTHER INFORMATION ORMANAGEMENT THEREOF, INCLUDING FOR ANY LOST, INCORRECT OR INCOMPLETE TICKETAPPLICATION FORMS,

(II) TECHNICALMALFUNCTIONS, SUCH AS ANY FAILURE OF COMPUTER HARDWARE OR SOFTWARE OR ANYINTERNET OR PRINTING MALFUNCTIONS,

 

(III) FAILURE TOCOMMUNICATE WITH ANY TICKET APPLICANT BY E-MAIL, POST, SMS, FAX OR OTHERWISE,INCLUDING THE FAILURE TO DELIVER, OR DELAYED DELIVERY OF, THE TICKETCONFIRMATION VIA THE TICKET APPLICANTS’ EMAIL, PHONE OR THROUGH ANY OTHERSERVICE PROVIDERS, OR

 

 

(IV) DELAY, OR FULL OR PARTIAL FAILURE, TO MAKE PAYMENT TO, OR RECEIVEPAYMENT FROM, FIFA BY THE TICKET APPLICANT PURSUANT TO THESE TICKET SALESREGULATIONS FOR WHATSOEVER REASON.

 

16. Contact Information

Any information requests relating to Tickets, these Ticket SalesRegulations and/or the Ticket Application Form should be addressed to FIFAthrough the FTC. The address of the FTC will be made available at www.FIFA.com, in the Ticket Application Form and furtherTicket sales materials which FIFA may choose to publish.

 

17. Miscellaneous

17.1 Should any provision(s) of these Ticket Sales Regulations and/or the Ticket Application Form be declared void, ineffective or unenforceableby any competent court, the remainder of theseTicket Sales Regulations and/or the Ticket Application Form will remain in effect as if such void,ineffective or unenforceable provision(s) had not been contained.

17.2 These Ticket Sales Regulations and the Ticket Application Form have been drafted in Portuguese andbeen translated inother languages. In the event of any discrepancy between the Portuguese and translated texts, the Portuguese text will always prevail and will always be used tosolve doubts of interpretation and application.  

 

17.3 To ensure continuityof application and clarity, to the extent allowed by applicable laws, these TicketSales Regulations and the Ticket Application Form will be governed exclusivelyby, and interpreted in accordance with, the laws of The Federal Republic ofBrazil.

 

17.4 To the fullest extentallowed by applicable laws, for all disputes regarding and in connection withany rights and obligations deriving from these Ticket Sales Regulations and theTicket Application Form, the parties will seek to resolve such disputeamicably. If FIFA and the Ticket Applicant or Ticket Holder, or its successor,fail to reach such amicable solution, to the extent allowed by applicable lawsthe exclusive place of jurisdiction shall be Rio de Janeiro, Brazil.Irrespective hereof and subject to applicable laws, FIFA reserves the right tobring any legal action in relation to these Ticket Sales Regulations and theTicket Application Form in the local court of the domicile or residence of theTicket Applicant or Ticket Holder.

 

17.5 These Ticket Sales Regulations, the GTCs and theStadium Code of Conduct are: (i) registered with the Registry Title and Deed (”Registro de Títulos e Documentos – RTD”)(ii) made available to all Ticket Applicants and Ticket Holders at www.fifa.com; (iii) provided to any person upon request at thecontact address set outin section 17 above; (iv) provided to the TicketApplicant in order to be distributed by him/her to every of his/her Guests; and(v) posted at the Venue Ticketing Centers.
